WEDDING FILM & PHOTO

  1. When booking a non-refundable deposit of 25% of your total cost is required to secure your date.
  2. Although by paying a deposit Serenity are not accountable for any unforeseen problems that may occur on the way to the venues, during filming and or photography work, (Inc bad weather, traffic problems, vehicle problems etc.) We regularly check all equipment and, if possible, carry spare equipment, but we shall not be liable for any unforeseen losses, omissions or problems, that occur during or in post production and will only be liable for, at the company owners discretion, to reducing the original cost or a refund in extreme circumstances. All filming and photography is subject to local conditions.
  3. Cancellations less than six weeks before the Wedding date will result in your full balance being due to be paid. Change of date is accepted although this is subject to the date being available otherwise this will be classed as a cancellation.
  4. The balance is due a minimum of six weeks prior to the Wedding date, and must be settled in full otherwise filming and or photography cannot commence.
  5. By booking Serenity, we assume you have cleared with the church and Venue’s all filming rights, and in some cases, paid for the privilege of having the ceremony filmed at the church and establish our filming position with the venue. It is also essential that you ascertain from the vicar/ priest/ registrar etc. the positioning for filming or photographing the service; please let us know two weeks in advance.
  6. Any additional charges / out of pocket expenses whatsoever e.g. car parking, toll road charges etc. are in addition to the stated package prices. Please try to ensure car parking spaces or location of parking is available at all venues we are attending.
  7. The Price Lists and packages quoted are for all services starting no earlier then 08:00am or later. If you require an earlier start time than there is an extra charge or a reduction in final filming time may be applicable Please contact us to discuss.
  8. Any differing aspects to the day should be submitted in writing a minimum of two weeks before the wedding date so we can prepare, If in doubt please contact us to discuss. If we do not receive this in writing we cannot be accountable for any omissions.
  9. Normal postproduction time is twelve to sixteen weeks from your Wedding date. This is an estimate and Serenity will notify you of any change.
  10. Any requests regarding the editing of your film or photos must be received and agreed in writing before editing commences. If we don’t not receive/agree this before the start of your edit we cannot be accountable for its omission. Any changes required after editing will incur a charge.
  11. Creative Brief – Unless otherwise agreed, the Customer accepts the Company’s decisions on creativity within the product(s) or service(s).
  12. Any queries must be received in writing within 48 hours of delivery of finished product. Serenity cannot be held responsible for removal and disposal of raw footage after this time accident or otherwise.
  13. Serenity will produce and store master versions of your productions and photo portfolios for a period of 24 Months from the Wedding date this is in case of any queries or problems, after this period the productions and portfolios will be fully deleted from our storage facility. Therefore in the event that replacement copies are required please submit this request during this time. Serenity is not accountable for any damage to any master file copies, and stores them as a courtesy; we would like to note that we do not charge for master file version storage.
  14. Master versions are stored at Serenity studios and remain the property/copyright of Serenity during this time.
  15. The copyright and all other rights in the Photos and Film shall be retained by Serenity. We assert the right to be credited as the author of the Photos and Film in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos or Film will constitute a breach of copyright.
  16. Copies will be made available after production for a period of 24 Months. It is against the law to copy or use any of Serenity’s productions or photos yourself. It is for your benefit that you use us for copies, as we have a high quality master to take a copy from which retains optimum superior quality.
  17. No Serenity productions may be broadcast on television or in a public place without prior permission from us.
  18. DVD and Blu-ray – Due to some minor compatibility problems relating to DVD and Blu-ray transfer, Serenity cannot be held responsible for DVD or Blu-ray Authored Wedding productions that do not play on your home Player. However if the Demonstration Disc that we supplied on the day of our initial appointment worked, then we do not foresee any problems
  19. If you choose to order digital files and have them printed at a place of your choice Serenity cannot be held responsible for the quality of the printing or the quality of the products. All digital files are provided as high resolution and it is the client’s responsibility to source a printing service that can provide prints using high-resolution files.
  20. Any products should be inspected upon collection from client. Once the client agrees to take the products they are accepting they are in satisfactory condition. Once digital files have been transferred either via Dropbox, email or USB they are non-refundable.
  21. Serenity may at our discretion use any footage, photos, names, and dates etc. for promotional activities. Including but not limited to via internet (including social media) and promotional material. If you wish not to be included in this then please contact us in writing.
  22. Serenity are covered by both Public Liability Insurance and Professional Indemnity Insurance.
  23. These terms and conditions of business and the contract between parties shall be construed and applied in accordance with the Law of England and Wales and shall be subject only to the jurisdiction of the English courts.

FAMILY SESSION & NEWBORN

  1. A 25% booking fee is due upon booking and is non-refundable. The deposit secures your session date and current pricing. The remainder of session package is due before or at the time of session. Newborn sessions are typically held within the first 10 days of life. If baby required a hospital stay we will complete the session once the baby arrives home. You will need to book your session within 2 days of arriving home from the hospital if not before. If you fail to contact us to schedule your session your deposit is forfeited or is applied toward a future session, which must be scheduled within 6 months from original booking date. There are no refunds on the deposit if you change your mind after the baby arrives since your date has been reserved and held preventing other clients from booking. Refunds will be given in extreme cases and are at the discretion of Serenity.
  2. A typical newborn session lasts 2-3 hours. In order to guarantee the client a full gallery of images, the photographer must complete a typical workflow before attempting any special requests from the client. The completions of all special requests are left to the discretion of the photographer.
  3. Electronic Devices. Cameras, cell phone cameras, and camcorders are not permitted during sessions.
  4. Serenity will do everything they can to produce good quality images. However, if your baby or child won’t settle or they refuse to participate in the session resulting in little or no images taken then Serenity cannot be held responsible for this. In this instance Serenity will offer the chance to re-shoot at a reduced cost at a time suitable for Serenity although for newborn sessions it cannot be guaranteed that it will be in the 2 weeks time frame.
  5. The copyright and all other rights in the Photos shall be retained by Serenity. The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright.
  6. The Client recognises that the Photographer may use any of the session images for business promotion, instructional purposes or as work samples, including but not limited to via internet (including social media) and promotional material. If you wish not to be included in this then please contact us in writing.
  7. Copying, scanning or print screening any images unless agreed within our packages is strictly prohibited.
  8. In the unlikely event of total photographic failure, injury or sickness beyond the Photographer’s control, our liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Serenity holds full Public Liability Insurance.
  9. Serenity shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. b) The Client understands and accepts that the photographic coverage will be as Serenity’s professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. c) In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.
  10. If you choose to order digital files and have them printed at a place of your choice Serenity cannot be held responsible for the quality of the printing or the quality of the products. All digital files are provided as high resolution and it is the clients responsibility to source a printing service that can provide prints using high resolution files.
  11. Images are held with Serenity for a period of twenty four months however once images have been purchased they should be backed up by the client and Serenity are      no longer responsible for any digital files once they are taken by the client. The USB they are supplied on should be returned if faulty within 14 days. After this time        Serenity has no responsibility regarding the USB.
  12. Any products should be inspected upon collection from client. Once the client agrees to take the products they are accepting they are in satisfactory condition. Once digital files have been transferred either via Dropbox, email or USB they are non-refundable.
  13. If you are more than 1 hour late for your appointment without notification the appointment will be cancelled.
  14. Sessions including family sessions are restricted – if you require a large family photo please contact to see if this is possible.
  15. Serenity are covered by both Public Liability Insurance and Professional Indemnity Insurance.
